1. Provider and scope
1.1 The provider of the Logiwolf web analytics platform (hereinafter “Logiwolf” or the “Service”) is:

1.2 These GTC apply to all contracts between Foldercrate (hereinafter the “Provider”) and persons or companies using Logiwolf (hereinafter the “Customer”). By registering a Logiwolf account, the Customer accepts these GTC.
1.3 Deviating or supplementary terms and conditions of the Customer do not become part of the contract unless the Provider expressly agrees to their application in writing.
1.4 The Provider reserves the right to amend these GTC at any time. Amendments will be communicated to the Customer by email at least 30 days before they take effect. If the Customer does not object within this period, the amendments are deemed accepted; in the event of an objection, either party may terminate the contract at the end of the current billing period.
2. Leistungsumfang
2.1 The Provider makes a cloud-based web analytics platform available to the Customer, allowing the Customer to analyse the use of their own websites in a privacy-friendly manner.
2.2 The exact scope of features depends on the plan chosen by the Customer. The current plans are available atlogiwolf.com/preise einsehbar.
2.3 The Provider is entitled to continuously develop the Service, add new features and adjust existing ones. Material reductions in functionality will be announced to the Customer at least 60 days in advance.
2.4 The Provider aims for an availability of 99% as an annual average. For Enterprise plan customers, a contractually guaranteed availability of 99.9% applies in accordance with a separate service level agreement (SLA).
2.5 Planned maintenance is generally announced to the Customer at least 24 hours in advance by email or in the dashboard. Emergency maintenance may be carried out without prior notice.
3. Conclusion of contract and trial use
3.1 The contract between the Provider and the Customer is concluded upon the Provider's confirmation of registration.
3.2 The Provider offers a free forever plan (“Free”). Use of this plan requires no credit card but is subject to the limits described in the plan overview.preise.html beschriebenen Limits gebunden.
3.3 Paid plans can be tried without obligation for 14 days at no cost to the Customer. After the trial period, the account converts automatically into a paid subscription only if the Customer has actively provided payment details; otherwise it reverts to the Free plan.
4. Prices and payment terms
4.1 The current prices are shown atlogiwolf.com/preise and are stated in Swiss francs (CHF) including Swiss VAT.
4.2 Billing takes place in advance for the respective billing period (monthly or annually). Annual plans are offered at a discount of around 17% compared with monthly payment (equivalent to two months free).
4.3 Accepted payment methods are credit card (Visa, Mastercard, American Express), TWINT, PayPal, and invoicing for annual plans and enterprise customers. Payment processing is handled by the payment provider Stripe; its privacy terms apply in addition, see theprivacy policy).
4.4 For payment by invoice, a payment term of 30 days net applies. In the event of late payment, the Provider may charge default interest of 5% p.a. in accordance with Art. 104 of the Swiss Code of Obligations, plus a reminder fee of CHF 20 per reminder.
4.5 If the pageviews included in the plan are exceeded, the account is not locked. The Provider informs the Customer by email. An upgrade may be suggested in the following month.
4.6 The Provider reserves the right to adjust prices. Price increases will be communicated to the Customer at least 60 days in advance. In that case, the Customer is entitled to terminate the contract as of the effective date of the price increase.
5. Contract term and termination
5.1 The contract is concluded for an indefinite period.
5.2 Monthly billed plans may be terminated by the Customer at any time effective at the end of the current billing period. Annual plans may be terminated at any time effective at the end of the annual term.
5.3 The Customer terminates directly in the dashboard under “Account” → “Cancel subscription” or by informal notice tohello@logiwolf.com.
5.4 The Provider may terminate the contract with 90 days' notice effective at the end of a billing period.
5.5 The right of both parties to extraordinary termination for good cause remains unaffected. Good cause includes in particular:
- Wiederholter Default in payment of more than 30 days despite reminder
- Breach of the obligations under section 7 (acceptable use)
- Opening of insolvency proceedings over the assets of a party
- A material change in the legal situation that makes the Service unreasonable
5.6 After the end of the contract, the Customer's data is retained for 30 days to allow possible reactivation. Thereafter, all personal data is deleted unless statutory retention obligations require otherwise.
6. Customer obligations
6.1 The Customer undertakes to provide truthful and complete information upon registration and to keep it up to date.
6.2 The Customer is responsible for keeping their access credentials confidential. The Provider must be informed without delay of any suspected unauthorised use of the account.
6.3 The Customer ensures that they are entitled to deploy the Logiwolf tracking pixel on the websites on which they install it.
6.4 The Customer undertakes to comply with all statutory provisions, in particular in the areas of data protection, competition and copyright.
7. Acceptable use
7.1 The Customer undertakes not to use Logiwolf for the following purposes:
- Tracking on websites with illegal, violence-glorifying, pornographic or otherwise unlawful content
- Tracking of visitors who have not been informed about the use of web analytics, where a duty to inform exists
- Circumventing the technical limits of the chosen plan (e.g. splitting across multiple accounts to avoid pageview limits)
- Reverse Engineering, Dekompilierung oder unautorisierte Modifikation des Logiwolf-Pixels oder Dashboards
- Attempts to intrude into the Logiwolf backend or compromise its security
- Resale or transfer of the Logiwolf services to third parties without express permission (except under the Enterprise plan with white label option)
7.2 In the event of violations of these acceptable use terms, the Provider reserves the right to suspend the account or terminate the contract without notice.
8. Data protection and data processing
8.1 The processing of personal data is additionally governed by theprivacy policy as well as thedata processing agreement.
8.2 Where the Customer uses Logiwolf to process personal data of end users of their websites, the Provider acts as a processor within the meaning of Art. 28 GDPR and Art. 9 revFADP. The conclusion of a data processing agreement (DPA) is part of the contract.
8.3 Data processing takes place exclusively in Switzerland (Zurich and Geneva). There is no transfer to insecure third countries.
9. Warranty
9.1 The Provider warrants the functionality described in the plan in accordance with the current state of the art.
9.2 The Provider is not liable for errors or outages caused by force majeure, acts of third parties (e.g. distributed denial-of-service attacks), maintenance work, or errors by the Customer in implementing the tracking pixel.
9.3 The Customer undertakes to report defects without delay after discovery tohello@logiwolf.com zu melden.
10. Liability
10.1 The Provider is liable only for damage caused intentionally or through gross negligence.
10.2 The Provider's liability for financial loss is limited in total to the amount the Customer paid to the Provider in the twelve months preceding the event giving rise to the damage – but at least CHF 100.
10.3 Liability for lost profit, indirect damage or consequential damage is excluded to the extent permitted by law.
10.4 The statutory exclusions and limitations of liability for slight negligence in the breach of material contractual obligations remain unaffected.
11. Geistiges Eigentum
11.1 All rights in the Logiwolf Service, the tracking pixel, the dashboard, the logo and all other content remain with the Provider.
11.2 For the duration of the contract, the Customer receives a simple, non-exclusive, non-transferable right to use the Service within the scope of the contractual provisions.
11.3 The data collected by the Customer with Logiwolf remains the property of the Customer. The Provider processes it exclusively to provide the Service.
12. Applicable law and place of jurisdiction
12.1 The contractual relationship between the Provider and the Customer is governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
12.2 The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Solothurn, Switzerland. The Provider reserves the right to sue the Customer at the Customer's general place of jurisdiction as well.
12.3 Mandatory jurisdiction provisions for consumers in the EU or the UK remain unaffected.
13. Final provisions
13.1 Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the valid provision that comes closest to its economic purpose.
13.2 There are no verbal side agreements. Amendments and additions to these GTC require written or text form.
13.3 The Provider may transfer rights and obligations under this contract to a legal successor, provided this does not unreasonably disadvantage the Customer. The Customer will be informed of any such transfer in advance.
